Bankruptcy numbers have risen dramatically during the last few years. An individual can declare themselves bankrupt by completing a Court form and paying a fee. An Official Receiver is appointed to determine if there any assets of value that can be realised for the benefit of creditors.

You may still have to pay a monthly amount into your bankruptcy, for up to 3 years, if you have a monthly disposable income.

The bankruptcy is advertised in a national and local newspaper and recorded on the internet. This is purely so that creditors can recognise your bankruptcy and make a claim to the Official Receiver.

If you are a home owner and have equity in your property, you have 3 years from the date of the Bankruptcy Order to realise it. If you have negative equity, the Official Receiver may be able to let you buy back the interest in your property for a nominal fee.

If you own a property with a spouse/ partner /and/or children then a period of twelve months from bankruptcy may be allowed for other living arrangements to be made for them. At the end of the twelve-month period, the property will have to be put up for sale, enforced by a Court order if necessary. However, if you own the property jointly with your spouse/ partner they may be able to make an offer to purchase your interest in the property from the Official Receiver.
